Terms & Conditions

1. General terms and conditions governing the use of the website of TheBasket Ltd -

These General Terms and Conditions shall apply in their current form to all business relations between TheBasket Ltd, hereinafter referred to as the “Seller” or “TheBasket”, and their customers – hereinafter referred to as the “User”.
1.1 The terms and conditions below shall govern the supply of goods and other services provided by TheBasket.
1.2 These terms and conditions shall apply to all customers unless TheBasket has executed a specific agreement with the particular user in writing.
1.3 The Seller shall provide the User with a catalog containing offers for purchase of goods and the User can purchase the goods offered through the WEBSITE by placing an order and paying the respective price upon compliance and strict observance by the User of these General Terms and Conditions and the additionally referred relevant requirements for the specific goods.


2.1 The User can order goods or services by filling in an online order form, thus making an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, by which the User declares that he/she is familiar with these Terms, accepts them and agrees to observe them.
2.2 These General Terms and Conditions shall automatically come into force and apply to the settlement of the relations with the User who has placed an order to purchase goods and/or services provided by TheBasket. The Agreement shall enter into force when TheBasket and the third party provider confirm this order.


3.1 The order for purchase and delivery of goods shall be placed by filling in the order forms provided on the WEBSITE concerning the purchase and delivery of goods. TheBasket do not sell directly in countries where have importer. Please check section "Partners"
3.2 The User undertakes to provide accurate data of the person who is to receive the goods and the place of delivery.
3.3 The order automatically includes data concerning the type, quantity and precise final price (including VAT) of the goods ordered.
3.4 Ordering a particular product is made by pressing the button ADD TO BASKET and then BUY on the page containing the offer of the desired product, and doing this the User expressly confirms his/her order and agrees with the General Terms and Conditions published on the website by checking the box “I accept the General Terms and Conditions of TheBasket and confirm the order made.” This action is a statement that constitutes a binding agreement between the User and the Seller, based on the terms and conditions set out herein and the provisions of the Consumer Protection Act respectively.
3.5 Upon receiving the order and within 24 hours the Seller shall send an email message to the User confirming the order or sending a notice in case any of the ordered items is unavailable.
3.6 The purchase price becomes immediately due. The payment of the purchase price may be carried out by any credit card recognized by TheBasket .
3.7 All prices are in EUR, incl. VAT, and are subject to unilateral modifications by TheBasket. Any changes in the prices made after the Seller has confirmed the order shall not affect the confirmed order.


4.1 The delivery of the ordered goods shall be carried out subject to the following conditions:
4.2 The ordered goods shall be delivered to the address specified by the customer. The User undertakes to provide access, recipient and opportunity for receiving the goods.
4.3 The goods ordered by the User shall be SENT within 2-3 working days to the address specified by the User provided that the order has been confirmed by the User and the delivery address is correct and valid.
4.4 The ordered goods shall be delivered properly packed according to their type and the specific mode of delivery transport.
4.5 If a third party is authorized to receive and confirm the delivery of the ordered goods on behalf of the original User who has placed the order, the latter shall not be entitled to return the goods or to raise claims regarding delivery.
4.7 Delivery in BG:
We use the courier services Econt Express .
4.8 Delivery outside of BG:
Shipping: Sending by courier or by a cheaper method of transport, depending on the destination country. The User shall be responsible for any applicable customs duties.

We also use the courier services Econt Express or DPD.
4.9 Payment for delivery to countries other than BG:
Shipping and packing costs shall be calculated based on the price list of the courier company and borne by the customer. Credit Card: Credit card (Euro/Mastercard or Visa).


5.1 The User who has ordered goods from the WEBSITE shall be entitled to refuse to receive the goods ordered upon their delivery only in the cases specified in these General Terms and Conditions:
5.1.1 If the delivered goods clearly do not correspond to the goods ordered by the User and that can be established by a routine inspection of the goods;
5.1.2 If the goods or their packaging are damaged during transportation;
5.1.3 If the price due by the User does not correspond to the price initially offered on the WEBSITE;
5.1.4 If the deadline specified for delivery has not been met;

Any claims based on the aforementioned conditions shall only be made at the time of delivery.

5.2 Apart from the foregoing cases, the User may not refuse to receive and pay the goods ordered by him/her. Otherwise the User shall also be liable to pay the costs of delivery and return of the goods.
5.3 In the event that any goods are refused to be received, a report shall be drawn up at the time of delivery. If the User refuses to sign the report the User’s refusal to receive the goods shall be considered unfounded and the User shall be bound to pay the costs of delivery and return of the goods.
5.4 After having received and paid the goods, the User may make a claim and require the return of the goods and reimbursement of the price paid in the following cases:
5.4.1 In case of significant defect or discrepancy of the goods that could not have been detected by routine inspection of the goods;
5.4.2 If during the use of the product, it shows a significant defect that makes it unfit for its intended purpose;
5.4.3 Without giving any reason for returning the product if it is in its original form, packaging and quality.

5.5 The claims shall be accepted as follows:

5.5.1 The User shall be entitled, without compensation or penalty and without giving any reason, to refuse the purchased goods within 7 working days of the delivery of the respective goods.
The SELLER shall reimburse the User the full amount paid by the User within 30 days from the date on which the User has stated his/her refusal.
The transportation costs for returning the purchased goods shall be borne by the User. To be returned, the item must be in excellent commercial appearance:

- The product must have not been used;
- The packaging has been preserved;
- The receipt or invoice has been preserved;
5.6 Any goods delivered by TheBasket shall remain the property of TheBasket until all contract requirements have been met.
5.7 3A guarantees that the goods do not have any defects that might reduce their value or their suitability for normal use for which they have been provided in accordance with the Agreement. If the reduction in value or suitability is insignificant, the claim may be rejected.
5.8 The warranty period is 24 months and shall start from the time when the goods are handed over to the User. Any defects in the goods shall be eliminated by TheBasket after it has been informed by the User within this warranty period. It is up to TheBasket to decide whether to replace or repair the goods. 5.9 The User shall be bound to inspect the goods immediately upon receipt and in case of establishing any defects, the User must inform TheBasket in writing within 7 days. The same rules shall apply for any defects that are discovered later. If the User fails to inform 3A in writing, the goods shall be deemed approved.
The following procedure shall be followed in the case of goods damaged during transportation:
If a package arrives visibly damaged, it must be opened in the presence of the courier. The courier then shall issue a certificate to confirm the damage.
5.10 For damages during transportation which are not obvious, i.e. the User establishes them only after opening the delivered package, the User must immediately notify the courier and obtain a certificate of damage. It is not possible to accept a claim for damages without such document.5.10
If no repairs are possible to be carried out within a reasonable period of time specified by the User, the User shall be entitled to request a reduction in price or to cancel the Agreement.
5.11 In case we need to return you money for paid to us with a card contracter or delivered/performed goods or services, we will refund you by a credit transaction on the card used for the original purchase.


6.1 The payment for goods ordered shall be settled as follows:
6.1.1 Cash on delivery - only on the territory of BG and RO: The User pays for the ordered product at the time of delivery by giving the relevant cash to the courier.
6.1.2 The purchase price can be

 - major credit cards as listed master card , Master card Electronic, Maestro, Visa,  Visa Elektron, V PAY

 -  make bank transfer. 

§ Please note that your V PAY or MasterCard Electronic card will be accepted only if it is registered for participation in the online authentication schemes Verified by Visa or MasterCard SecureCode.

will not be charged VAT but may incur tax from the receiving country.The TheBasket are not responsible for any charges incurred once goods have been transferred to the courier.


8.1 The Seller undertakes not to disclose any personal information of the User and not to provide the collected information to third parties - public authorities, companies, individuals, etc., except in the cases when:
8.2 The information is required by state bodies or officials authorized under the effective legislation to require and collect such information in compliance with the statutory procedures;
8.3 In other cases specified by law.


9.1 The User shall be entitled to freely use the resources on the WEBSITE except for the restrictions described in these General Terms and Conditions and other common applicable restrictions.
9.2 The users of the WEBSITE may not copy, distribute or use any texts, images or parts of the WEBSITE without the explicit authorization of the Seller.
9.3 The User may not overload the WEBSITE with false orders or other information.
9.4 The User of the WEBSITE may not perform any acts which violate the generally established rules of contact and communication, may not perform malicious acts, spread viruses and similar acts, violating or infringing the rights and the interests of third parties.
